It is serious because the department has been given the power to make decisions on issues that directly affect the position and performance of judges, including the possibility of having them prosecuted or detained.
& ndash; The European Court of Justice has previously said that Poland must suspend the activities of the department, but the country has not yet complied.
The government states in the press release that the Polish Constitutional Court has recently questioned whether all decisions of the European Court of Justice need to be complied with and thus created doubts as to whether the primacy of Union law will be respected. The German Constitutional Court also reached a similar decision earlier.
