The Swedish government states in a press release that the government has decided to support the EU Commission in a case against Poland that it brought before the European Court of Justice.

The government states in the press release that the commission's criticism several points apply to Poland, including the possibility of imposing criminal judges, which the EU opposes.

& ndash; The Supreme Court has a department for disciplinary cases whose independence and impartiality are not guaranteed. It is serious because the department has been given the power to make decisions on issues that directly affect the position and performance of judges, including the possibility of having them prosecuted or detained.

& ndash; The European Court of Justice has previously said that Poland must suspend the activities of the department, but the country has not yet complied.

The government states in the press release that the Polish Constitutional Court has recently questioned whether all decisions of the European Court of Justice need to be complied with and thus created doubts as to whether the primacy of Union law will be respected. The German Constitutional Court also reached a similar decision earlier.
