But after new DNA analyzes have been made and the Supreme Court has granted rescission, the Court of Appeal now convicts the man of the crime.

The Court of Appeal concludes that the plaintiff's information is credible and that they receive such support from the investigation that the indictment is strengthened. The renewed DNA analyzes have shown DNA from plaintiffs on the wrong side of the man's underpants. The man has provided an explanation for the DNA trace in the Court of Appeal, but according to the court the explanation was given at a very late stage and the Court of Appeal considers it not credible.

Since it has been a long time since the act was committed, the Court of Appeal has considered that the 64-year-old should be sentenced to a lighter sentence than the minimum sentence for rape of a child. He is sentenced to one year and eight months in prison.
