Apple has in the United Kingdom an appeal against Samsung lost. The court found that the design of the Samsung tablets are not to many seemed to be that of the iPad. Apple should be a half year long ads publishing with the claim that Samsung the iPad are not copied.
Apple claimed again that the appearance and shape of Samsung Galaxy Tab tablets to many similarities with that of the iPad. The manufacturer from Cupertino is of the opinion that the appearance of the main feature, because users here constantly thinking about it. The court found, however, that the Samsung tablets are distinctive enough.
The court argued why Apple, in the media, it is clear that Samsung and the iPad are not copied. “The issue is not whether Samsung the iPad has copied. In case of infringement of a registered design is not raised or copying. It is simply to or the conscious design similar to the registered design on the basis of the tests set out in the law.”
A spokeswoman for Samsung welcomed the judgement against the BBC. “We remain of the opinion that Apple is not the first company that was a tablet with a rectangular design and rounded corners designed and that the origin of the features from Apple’s registered design in many earlier examples to see.”
At the beginning of July was the first ruling in the case and the judge said, when all the sides and the backs of the competing tablets enough differed. Apple’s registration of the design dates back to 2004 and describes, among other things, the rounded corners and minimalist design.
