RIM has the penalty of 147,2 million dollars that it was imposed because of patentschending successfully challenged. The BlackBerry-maker was acquitted on appeal. The plaintiff, Mformation can still appeal the decision.

Last month, RIM found guilty of infringing on a patent of Mformation that a technology describes for smartphones to remotely manage. The fine was related to the number of BlackBerry’s that is connected to a BES from RIM for business users; $ 8 per sold BlackBerry be paid. Because on appeal, a judge has decided that there is no patent infringement, the penalty also to be paid.

Mformation, RIM set the appeal still contested. Should it succeed, then a whole new lawsuit to be started. Because the initial charge already in 2008, it was submitted, it may then still take years before a decision is reached. It is as yet unclear whether Mformation will appeal the decision.

Not having to pay the fine of millions of euros is more good news for RIM, because the company for some time in heavy weather condition. There are declining sales of BlackBerry phones listed, while the new BlackBerry 10 operating system a number of times has been delayed. The first devices will come only in January next year. To the head above the water to keep considering RIM has a number of strategic options; initially it was talked about a demerger of the company, but now it seems RIM there is more to see for its new BlackBerry 10 operating system license.
