Tele2 and KPN get, as yet, no access to analog cable – update

Kabelaars as UPC and Ziggo have third parties such as Tele2 and KPN as yet no access to the analog cable, the board of Appeal for industry will be determined. This keeps the monopoly now still in position.

According to market surveillance authorities OPTA, there is enough competition for tv services via other techniques, such as iptv and Digitenne. Therefore, regulation of the market, which companies such as UPC and Ziggo have a monopoly have, not necessary, argues the regulator. The market is now divided; in each region there is a cable provider.

The CBb wiped the complaint of Tele 2, YouCa and KPN against the decision of the OPTA in order not to grab the table, because the OPTA, in fact, no decision had been taken. This is evident from the ruling, which Wednesday is published. The OPTA decided last year not to grab on to the cable connections and it is a closed monopoly. There can be no objection be made against a measure that OPTA has not taken, for example, in the college.

Tele2 and KPN wanted to make their services completed with analog tv. Tele2 offered even kortstonding analog tv, but by a court ruling went the cable connections lock it again.

Update, 11:42: Tele2 let you know that there is another case running at the College of Appeal for businesses, in which the opening of the cable connections, however, the content will be treated. That case is on the schedule for treatment in september.

Also, the First Room with a change in the law this spring, the opening of the analog cable is a mandatory requirement. However, it is the question of whether the law is legally acceptable. According to the European rules should probably only the OPTA that decide and not the legislature. If the OPTA is located, the cable connections are closed. Probably will also here a judgment must show whether the cable connections open.
