The U.s. International Trade Commission has ruled that HTC some smartphones no longer allowed to import and sell in the US. The prohibition, pronounced at the request of Apple, seems to have an effect.

Although the ITC in its decision, does not mention which devices will be forbidden, claims The Verge that the patent in Android versions 1.6 to 2.2 is violated. HTC delivered, amongst others, the bestselling puzzle American aircraft Droid Incredible and Evo 4G with Android 2.2, so this may be excluded. HTC for these devices, however, already have an update to 2.3 available, which is no longer being infringed on this particular patent.

HTC has also, in response, indicated that it has prepared the decision of the ITC. The manufacturer would already be an alternate technique to work around the patent infringement in its phones to get around. It is therefore possible that HTC’s new software ensures that after april 19, however, Android phones can continue to sell in the US.

Since the conscious technique in the patent in Android itself is implemented, it would be Apple, this allows other manufacturers of Android devices for the judge can drag. The company from Cupertino is, however, already with several manufacturers in lawsuits involved, including Samsung. Recently passed Apple to a German court for a sales ban to impose for Galaxy Tab tablets.

It is still possible that the statement is blocked by the head of the ITC, but this rarely happens. This seems to be HTC little against the sales ban to be able to do. The import and sales ban is on 19 april of next year, so that providers have time to of their stock. According to the ITC makes the Taiwanese manufacturer infringed on patent 5,946,647, Apple, a technique describes an action to perform on a data structure by a computer is generated.

Previously HTC already found guilty of violating two Apple patents, but ultimately bases the ITC are ruling only on the patent number 5,946,647. It was not stated which devices exactly are infringing on patent 5,946,647, but from the determination of the ITC is to make that not all HTC smartphones in the US to be sold. The earlier ruling that HTC infringes on patent 6,343,263 was reversed. In the lawsuit brought Apple two patents, but this had the ITC previously determined that HTC is not infringing on.

HTC complained to Apple because of patentschending, but the company from Cupertino was found not guilty. Also, the company S3 Graphics, which HTC acquired, complained to Apple because of the violation of patents, but also here, the court found otherwise.
