Finland is right in cases of fake Iraqis

Law & Right. European Court of Justice punished Finland after an Iraqi man was allegedly murdered in his home country after being deported from Finland. But the murder turned out to be fake – and now Finland is right, reports Yle.

The man, who in the media has been called Ali, was alleged to have been murdered shortly after he returned to Baghdad after being deported from Finland.

In November 2019, the European Court of Human Rights ruled that Finland had not considered the risks of sending Ali home in a way that was in line with the Convention on Human Rights. Finland was sentenced to pay damages of approximately SEK 250,000.

But in the spring of 2020, it was revealed that Ali was in fact alive. It turned out that the Iraqi's daughter and former son-in-law had lied about the story of the murder in order to get compensation from Finland. The death certificate was forged.

Now the European Court of Justice has overturned the verdict against Finland in its entirety.

– The case is unique. Finland has never before asked for a review of an issue that was resolved in the European Court, says Krista Oinonen, Finland's State Representative in the European Court, to Yle.
