Domestic. An Afghan who claims to be 24 years old is charged with two rapes and one sexual molestation at the University Hospital in Uppsala in December 2021. Despite the fact that he was then investigated for another rape, the man received Swedish citizenship during the course of the investigation – and now he cannot be deported.

The man is accused of having performed sexual acts comparable to intercourse on a woman in her 50s. The woman was admitted to the hospital in 2021 and was treated for a serious medical condition. According to the indictment, the abuse took place when she was admitted to an emergency care unit.

Because of the illness, the woman had certain physical limitations. Due to the fact that the covid restrictions applied during December 2021, the woman was also not allowed to receive visits from relatives, which meant that she was isolated.

– I mean that the man has improperly taken advantage of the fact that the woman has been in a particularly vulnerable situation due to her serious illness. I also want the court to examine whether she can be considered to have been dependent on the defendant, in light of the fact that she was very ill and that the man was responsible for parts of the supervision and some nursing of her. In all circumstances, these sexual acts were carried out against the woman's will and she did not participate voluntarily, says assistant prosecutor Karin Persson.

The Afghan was tasked with supervising the woman as a so-called vigilante, but was not medically trained . The evidence in the case consists of, among other things, the woman's story, journal entries from the hospital and technical evidence.

– In my opinion, it is an aggravating circumstance that these rapes took place when she was seeking help and was so seriously ill that she needed emergency care. There has also been a question of repeated abuse, says Karin Persson in a statement.

The Afghan man has also previously been detained for a rape which is said to have taken place in August 2024, which was previously reported. However, the suspicions in that part have weakened, the man is no longer in custody for that suspicion and that act is not covered by the indictment.

The Afghan received Swedish citizenship in May this year and therefore cannot be deported under current legislation. According to Expressen, he was granted citizenship while he was being investigated for another, aggravated, rape. However, that investigation has been closed today.

The accused has previously also been detained for a rape which should have taken place in August 2024. However, the suspicions in that part have weakened, the Afghan is no longer detained for that suspicion and that act is not included in the charge.
