According to the court, municipalities may not decide on matters that it is up to the state to decide on, and the decision is therefore annulled.
“Manifesting one's disapproval of the actions of certain states in a decision on boycott is an example of an expression of opinion in the foreign policy area that it is up to the state to make. The appealed decision therefore falls outside the municipal competence and must be annulled”, writes the administrative court in its judgment, according to Samnytt.
According to Eneblad, the members of the municipal committee who made the decision were fully aware that they were pushing through an illegal decision, and he therefore believes that they should resign.
– We see it as a very big victory. The chairman of the board, Eva Ternegren, who is an environmentalist, resigned a few weeks ago because she thought it was inappropriate for the board to make this type of illegal decision. And I think it is dressy in such a case that those who have nevertheless chosen to fight through an illegal decision and also run over the administration's own proposal for an opinion to the court now also take and leave, says Eneblad, who is a law student, to Samnytt.
