Hof: Delta must lay fiber optic in the Westland rural area within a year and a half

Delta Fiber must install fiber optic cables to at least 62 households in the rural areas of the Dutch Westland region within a year and a half, the Court of Appeal has ruled. The Court agreed with an earlier ruling by the judge.

Delta Fiber found the construction too expensive because there are many waterways and nature reserves in the area. When registering, the company set the only condition that 50 percent would register and that percentage was achieved. The Court of Appeal agrees with the judge that the unexpectedly high costs are not a 'compelling reason' to abandon the construction.

The Court says that it is the company's own responsibility. “Apart from this, it is incomprehensible that Delta Fiber has not made an explicit reservation in the agreement with respondents with regard to the costs that, according to its statements, cannot be estimated in advance. Delta Fiber could easily have done this and, apparently also from a cost point of view, it did do so. with regard to the percentage of participants. In that case, respondents would have known where they stood. Now that is not the case, Delta Fiber is largely to blame. “

The Court's ruling stipulates that Delta Fiber will now install fiber optic fiber to 62 households in Westland within 550 days, which is by the end of 2025. Westland Verstandig reports that people who did not participate in the proceedings can still try to report to Delta if they had registered for the installation of fiber optic at the time.
