Privacy foundation noyb has filed charges against Meta in eleven European countries for using posts and photos on Facebook and Instagram for 'AI technology'. Meta claims that right under the new terms and conditions.
The terms and conditions, which will take effect on June 26, state that Meta may use photos and messages that are public in addition to data from the public internet for AI, according to the terms and conditions. Private communication is not included, which means that Meta cannot use data from WhatsApp chats. Messages and photos on Facebook and Instagram do seem to fall under this.
Privacy foundation none of your business has therefore filed charges in eleven European countries, including the Netherlands. Meta claims that the AI technology, presumably the training thereof, is a 'legitimate interest' to use the photos and messages without asking permission. The foundation does not think so and the Norwegian privacy watchdog also doubts this. The Dutch regulator AP tells NOS that it is not authorized to handle the complaint.
Meta has language models under the name Llama, among other things. Versions of these are or will be included in almost all of the company's services, including WhatsApp and Instagram. Llama models are partly available under an open source license.
