The Dutch NIS2 law will not come into effect until the second or third quarter of 2025

The Cyber ​​Security Act, which should implement the European NIS2 directive in the Netherlands, is not expected to come into effect until the second or third quarter of 2025. The internet consultation for the bill is currently underway.

Outgoing Minister of Justice and Security Dilan Yeşilgöz-Zegerius reported in January this year that the legislation would not have been drawn up on time. The deadline for this was October 17, but the process turned out to be so complex that the law can only be submitted to the House of Representatives in the autumn.

Now Yeşilgöz and outgoing Minister Rob Jetten of Climate and Energy provide answers to parliamentary questions indicates that the law cannot enter into force until the second or third quarter of 2025. The parliamentary questions in question revolve around the (cyber) security of Dutch offshore oil and gas platforms. Member of Parliament Joost Eerdmans of JA21 wanted to know what measures have been taken to guarantee the safety of these platforms in the North Sea. The two ministers say that there are various partnerships and that various measures have been taken. The NIS2 is also involved in this, which must (further) anchor rights and obligations regarding cybersecurity.

On May 21, the internet consultation started for the concept of the so-called Cybersecurity Act, with which the NIS2 is converted into national legislation. During this period, anyone can make suggestions for improving the bill. The consultation will close on July 2 and all responses will be considered. The bill will then be amended if necessary. Only then will it go to the House of Representatives.
