EU opens investigation into Instagram and Facebook for failure to comply with DSA rules

The European Commission has opened an investigation into Facebook and Instagram. Both Meta platforms may not comply with the DSA rules for detecting and removing misleading and illegal content, especially around elections.

The European Commission suspects Instagram and Facebook of five different offenses, it appears from the announcement. The fact that the Commission is investigating does not mean that it thinks Instagram and Facebook are guilty. However, Meta will receive questions and requests during the investigation.

The first possible offense is that Meta is not doing enough against misleading advertisements and disinformation campaigns. The second is the suppressed visibility of political content on Instagram and Facebook, which may be against DSA rules. The third is the lack of monitoring tools available around the European and various national elections; the European Elections are in June. The fourth possible offense is that Meta's tools to have content removed are not sufficient under DSA rules. Meta has not yet responded to the complaint.
