Court of Appeal: Wrong by the police to stop Koran burning

Media. The police in Norrköping made a mistake when they prevented Rasmus Paludan from burning a Koran in April last year. This is announced by the Court of Appeal in a judgment.

The police decided to cancel the general assembly in Norrköping citing disturbances.

The Court of Appeal has now overturned the police's decision.

The court agrees that the decision should be overturned, but the members have different reasons for the decision. The majority does not believe that the provisions of the Public Order Act give the police the opportunity to cancel public gatherings as a result of disturbances that have occurred or are feared. Instead, it is the provisions on dissolving gatherings that may be relevant. These regulations have not been used by the police.

One member believes in and of itself that there is a legal possibility to cancel gatherings in the event of disturbances, but believes that the investigation does not show that the disturbances were so serious that it was justified.
