Fria Tider was able to tell yesterday about the strange accusations that Agnes Wold tweeted out at eight o'clock last Saturday night.

A seriously ill girl who is forced to use a wheelchair to move lies about her disease and can actually walk, claimed the media-known doctor. The girl “refused to get up,” tweeted Wold, who himself had never met or examined the sick girl.

Wold's statement has caused outrage on social media where many are wondering if a doctor can spread that kind of accusation around him.

Fria Tider has spoken with Henrik Johansson, who is a lawyer and has extensive experience of court proceedings. Last year, he won a high-profile case against the Swedish Academy and awarded damages to a musician who lost his record contract due to his political views.

– When Wold insinuates that this girl is lying about her illness, it is undoubtedly slander in an objective sense. Wold has, as it is called in the legal text, provided information about the girl who is likely to expose her to the disrespect of others, says Henrik Johansson.

Henrik Johansson explains that under certain conditions it may be legal to go out with information that may lead to someone being subjected to disregard. It is then required to begin with that the information is true or that the person leaving it at least had reasonable grounds to believe that it was true. Johansson, however, finds it difficult to see that Wold's statement could be legal for that reason.

– She has apparently gone out with completely unfounded accusations without having had any sensible reason for it. I find it difficult to see that a court would come to any conclusion other than that this is libel if there is a judicial review.

Defamation of the normal degree is punishable by a fine, but if the defamation is judged to be serious, imprisonment can be imposed ut.

– There are circumstances that suggest that this is gross slander. Wold's accusation is directed at a young man who is seriously ill and in a vulnerable position. It also seems as if the slander of the girl took place in front of a large audience, as many read what Wold writes on social media.

Wold's account on Twitter is followed by over 90 & nbsp; 000 twitter users.

The main rule is that the person who has been defamed and wants redress may pursue the case himself, as a so-called individual prosecution. But there are exceptions. Prosecutors can prosecute for defamation if it is considered “called from a public point of view”.

– The assessment of whether it is called for prosecution is made by prosecutors based on the circumstances of each individual case.

When it concerns Wold's tweeting if the girl speaks highly of a public prosecution being justified, says Henrik Johansson. girl and which gets wide spread. The fact that Wold is a doctor, I think makes it even more serious. Many people see her as an expert and believe what she says.

– So she can be prosecuted for this, it is possible that a prosecutor would make that assessment.

A prerequisite for public prosecution, however, is that the accused girl makes a police report, something that Henrik Johansson thinks is justified to do in such cases.

– It is a growing problem that the media and various media personalities attack individuals who can not defend sig. That is why it is very important that you report, he says.
