The 21-year-old is acquitted, however, because he is considered to have acted in self-defense and his actions in the situation that arose were not manifestly unjustifiable.

The district court emphasizes, among other things, that the attackers were numerically superior and armed of the 21-year-old's uncle. The risk of serious violence against the 21-year-old and his brother has therefore been imminent, according to the verdict.

Since the 21-year-old is acquitted, his brother can not be convicted of protecting a criminal.
