Sweden abolishes penalty rebates for serious crimes

Domestic. The special criminal treatment of criminals in the age group 18–20 means that “too much consideration” is given to age and that sentences imposed do not sufficiently reflect the seriousness of the crime, the government claims. That is why they now want to abolish the penalty rebate for more serious crimes, and open up to giving 18-year-olds life imprisonment.

According to the bill, which in all probability receives support in the Swedish Parliament, the penalty rebate will be abolished for those who are 18–20 years old and have committed a crime where the minimum sentence is imprisonment for one year or higher.

The same shall apply if the penalty value of the crime amounts to imprisonment for one year or more.

Nor shall special reasons be required to sentence offenders in that age group to prison, and the same punishment may be imposed as for other adult offenders, such as life imprisonment.

Furthermore, it is proposed that the special juvenile sanctions should in principle be reserved for persons under 18 years of age at the time of the crime. Anyone over the age of 18 should only be sentenced to one of the juvenile sanctions if there are special reasons for it.

Furthermore, it is proposed that certain serious crimes, e.g. murder or rape of a child, shall not be statute-barred if the crime was committed by someone over the age of 18.
