The rapist gets rid of refugee status – can stay anyway

Law & Justice. A rapist from Syria loses his refugee status in Sweden according to a new verdict. But at the same time as the court withdraws his refugee status, they grant him a residence and work permit in Sweden because he risks having to do the dirty work in his home country.

The man came to Sweden in 2016 and just like many other men from the Arab world, he pretty quickly chose to commit a rape in Sweden.

For the rape, which took place under knife threat, he was sentenced to 2 years and 8 months imprisonment and deportation. The man appealed the deportation all the way to the Migration Court of Appeal, which has now decided to revoke his refugee status but let him stay in Sweden anyway, on a temporary residence permit.

The man will thus not be deported after the prison sentence, which Bulletin incorrectly reported on Tuesday.

According to the court, the man has admittedly committed such a “serious crime” that gives Sweden the right to deport him despite the fact that he risks persecution in his home country.

But in the guiding judgment, the court also rules that there are “obstacles” to his deportation, as he is considered in need of protection “due to the fact that he may be called up for military service in the Syrian army”.

Although he lost his refugee status, he is therefore granted a residence permit and work permit in Sweden to avoid doing the dirty work in Syria. The residence permit is “temporary” and the deportation decision is not revoked, but in practice the residence permit is permanent because the risk of ill-treatment in Syria must have ceased in order for the deportation to be enforced.
