Prosecution: Tried to defraud millions in corona grants

According to the indictment, the representative of ApartDirect applied for adjustment support of approximately SEK 1.7 million on incorrect grounds.

The crime also included the company's auditor who wrote false certificates about the company's turnover, according to the indictment. However, the Swedish Tax Agency discovered the error and no money was paid out.

The adjustment aid law came into force in June 2020. The law forms part of the measures that have been taken to limit the economic effects of the corona pandemic and entitles to financial support. for companies affected by reduced sales by more than 30 percent. So far, five charges have been brought, of which this is the first charge involving a serious crime.

– In its application for adjustment support, the company has provided incorrect information about its turnover. They had removed the turnover from a newly established hotel. In this way, their loss of turnover became so great that they would be entitled to financial support. The company's auditor participated in the crime by writing false certificates where the turnover from the newly established hotel was removed, says Gustav Nyström, head of preliminary investigation and chamber prosecutor at the Economic Crimes Authority in Gothenburg, in a statement.

The representative of the company and the company's auditor are charged. The representative for a serious adjustment aid breach in the first place, in the second place a negligent adjustment aid breach. The auditor is prosecuted for aiding and abetting these crimes and for falsely certifying. A company fine of SEK 1.5 million is claimed against the company and a multi-year business ban is imposed on the company representative.

– I am considering bringing an action for a ban on advising the auditor. Before such an action can be brought, however, an opinion must be obtained from the Swedish Auditing Inspectorate, says Gustav Nyström.
