Control over the constitutional court

The President and the Parliament are in Peru for three years in a constant state of conflict. The quarrels reached a new peak, as the Congress in which the Opposition has the majority, announced the beginning of a selection process for two new judges to the constitutional court. This is, however, without the possibility of a public application for this Post, as usually in Peru is common.

President Vizcarra called on the Parliament to “urgently”, a public application process to allow. He threatened the Parliament with dissolution if his claim will be rejected. However, the Parliament refused, and so Vizcarra was his announcement to the fact. “I would like to reaffirm that President Vizcarra did not commit a coup,” says the former Peruvian Foreign Minister and justice Minister Diego García Sayán in an interview with DW. “At this point of the conflict, the Congress had turned away from the people. Araoz: “Who wants this office?”

“The Problem is that Congress wanted to overturn the public application process, to hand-picked candidates for the constitutional court to choose to be close to the former President Fujimori,” explains Julio Panduro, political Analyst of the newspaper “El Peruano”. “This is obviously a political ploy, because as soon as this candidate to sit in the constitutional court, you can take the judicial decisions in favor of Fujimori-trailer influence and other parties damage,” says Panduro.

Impunity against carriage

In fact, there are currently criminal proceedings against several members of the Opposition in Congress. Some of them have to do with a corruption scandal involving the Brazilian construction company Odebrecht to. The most Prominent among them is opposition leader Keiko Fujimori. The daughter of former heads of state because of suspicion of corruption, for over a year in pretrial detention. They should not be re-elected, would be added to their cases by the judiciary again.

“With the appointment of well-minded judges, they wanted to secure their future impunity, because their cases would end up before the constitutional court. Beneficiaries judges could return the favour then,” said Panduro.

President Martín Vizcarra came only a year ago after the resignation of President Kuczynski to the office.

From the continuous power struggle on both sides are gone in a weaker state. In the population, the Parliament has lost a lot of support. According to the independent Peruvian research Institute IEP 70 per cent of citizens were in favour of in April, a resolution of the Parliament. On the other hand, there is a lack of the presidency of Martín Vizcarra to a clear line. The dominant theme of his term of office the duration of the dispute with the Congress. For other issues there is hardly.

The population supports the President

“This is a Situation you could see coming, because since the beginning of the current legislature in 2016, the Opposition has used its parliamentary majority to the government to make life difficult,” says Fernando Tuesto Soldevilla of the Catholic University in Lima. “It is this intense power struggle that led to the 2018 to the resignation of President Pedro Pablo Kuczynski. Vizcarra was well on its way to suffering the same fate. That’s why he has pulled the emergency brake now,” explains the expert.

With a dissolved Parliament, suspended the President-in-office, maneuvered the country into a very unstable situation. Vizcarras decision is supported by a large part of the Peruvian society. Who will win the power struggle, ultimately, it is still completely unclear.
