First glyphosate-action lawsuit against Bayer, a subsidiary of Monsanto in Australia

The wave of lawsuits because of the Weed killer glyphosate, has now reached Australia. There is a gardener from Melbourne sued the Bayer, a subsidiary of Monsanto, because of the alleged carcinogenic effect of their glyphosate-containing herbicide Roundup to the Supreme court of the state of Victoria. It is the first lawsuit of this kind in the continent, as his firm Carbone Lawyers announced on Tuesday.

The 54-year-old man named Michael Ogalirolo suffer, according to a report in the daily newspaper “Sydney Morning Herald” (Tuesday) is a malignant disease of the lymphatic system (Non-Hodgkin’s lymphoma). He is said to have used over a period of 18 years, the Monsanto weed killer Roundup. In the lawsuit, Monsanto is accused of Australia, to have health risks from Roundup-products not warned. The weed killer contains the active ingredient glyphosate. Bayer said in a statement that until now, only the media reports about the case were known, but not the action of the gardener himself.

US actions as a role model

The group also pointed to studies that Roundup for diseases such as Non-Hodgkin’s lymphoma could not be held responsible. In fact, the U.S. environmental protection Agency, EPA, glyphosate was classified until the beginning of may continue as non-carcinogenic. The International cancer research Agency of the world health organization (WHO) considers it as “probably carcinogenic”.

The action is based, according to the law firm on the recent Judgments of Roundup in the United States. There are now about 13,400 plaintiff because of the Monsanto developed a Weed killer. In two previous cases, the plaintiffs were awarded damages of a total of almost $ 160 million. Bayer has filed an appeal or announced, a lot of experts but in the end of an expensive comparison. According to the company, there is outside of the United States, only a “very small number” of complaints, including in Canada.
