France condemns Google to a million-penalty

France’s data protection authority has ordered rules Google to pay a fine of 50 million euros for breaches of data protection. For the Internet giant, the amount in question falls in the category of Peanuts.

In France there is the first major penalty in accordance with the new General data protection regulation (DSGVO): Google have not met the new requirements sufficiently, the data protection authority, CNIL imposed a fine of 50 million euros. The authority found violations of the DSGVO. In order for the CNIL is the first European Regulatory body, the punished on the basis of the since may of rules for a global Internet group.

The CNIL is not “contended that Google informed its users in a clear and understandable” on the use of your personal data. The authority went through this step-by-step, the registration of a user of the Smartphone operating system Android for a Google account. It was not in such a way that Google provides no information – however, these are often located several clicks and in the “various documents”.

Among other things, information about the use of the collected data and the storage period for users not easily accessible enough, – explained the authority. In addition, the Google consent for the display of personalized advertising was not valid, because the users were not sufficiently informed. The diversity of the involved Google be services, such as YouTube, Google Maps, or the Internet-not apparent, said the CNIL. In addition, a check mark is the default, while the DSGVO call for a “positive” acceptance, the user must, therefore, give consent themselves.

The Internet company said that he would decide after a detailed examination of the decision on its further action in the case. Google is determined to meet the high expectations of the users transparency and control over the data.

The penalty, however, is comparatively low for Google: So, the group had digested the two-billion-competition fines from the EU Commission in each case in only one quarter. The parent company, Alphabet posted in 2017, with a turnover of 110,9 billion dollars (97,56 billion Euro) and a profit of 12.7 billion dollars. After the DSGVO international corporations have to reckon with sensitive fines, if they violate the privacy of EU law. You penalties in the amount of up to four percent of their annual worldwide turnover, to threaten.

With the sanctions imposed by the CNIL followed the actions of two Individual: the Organisation is None Of Your Business (NOYB), the Austrian privacy activist Max Schrems, as well as the organization La Quadrature du Net to the authority, which represents nearly 10,000 French Internet users turned. The complaints were directly after the entry into force of the DSGVO submitted had been reviewed, the authority of the sites in September.

Schrems said after the CNIL’s decision that large corporations like Google have adjusted their offers only superficial. “It is important that the authorities make it clear that that’s enough.” NOYB (short for “None Of Your Business”) had also submitted DSGVO-complaints against other companies.
