Cabinet: Netherlands has immediate downloadverbod

It is in the Netherlands immediately forbidden to download copyrighted materials from illegal source, for example via torrentsites and newsgroups. That puts the government in a response to a ruling of the european court.

Earlier on Thursday, the European Court of Justice ruled that the Netherlands downloading copyright-protected material from any illegal source should not allow. This is in fact a downloadverbod introduced that directly applies, according to the government. “That means that downloading from illegal sources, directly is prohibited,” said spokesman Wiebe Alkema of the Ministry of Security and Justice.

The law does not need to be adjusted to a downloadverbod. There is currently no law prohibiting the downloading of copyright protected material from any illegal source permits: the cabinet and the Dutch judges were of the opinion that the copyright legislation in that way it can be explained. The European Court has now determined that that can not. The European Court is above the national courts, and thus has the pronunciation of Thursday, more weight.

Downloaders do not run the risk of persecution: it goes according to the government, not to a criminal but a civil prohibition.
