Google and Oracle have unable to reach agreement over a fee for the use of Java patents in Android. The case is now still by the court to be decided, so that the outcome is still pending.

From the document that is released by the Californian court, where the matter between the two parties, it appears that there will be no further negotiations are conducted. The court points out that Google and Oracle have had to focus on the seat that is already planned for 16 april. It is then determined whether Google infringes on two Java patents in Android, and a compensation must pay.

In earlier negotiations with Google with Oracle have tried to settle by an amount of 2.1 million dollars, and a small part of future Android revenues. Oracle struck the settlement proposal, however. The software maker wants more money, but reduced, in itself, a number of times the claim.

Also the number of patents in the lawsuit is called decreased from seven to two. Initially, there are billions of dollars required, but now it seems any amount of damages not more than a few tens of millions of dollars to be able to amounts. Therefore, the court must still patent infringement proven consider.

Oracle believes that Google, except on its patents, infringing on copyright. Because the Java-based Dalvik Virtual Machine in Android have the same class-hierarchy and syntax as Java has, would this infringe on the copyright of Oracle. Also in this case Google might pay compensation.
