High Council: the Netherlands foreign gambling sites fend off

The presence of foreign gambling sites and mobile gambling services is not in conflict with European law, so the supreme court ruled. The British Ladbrokes have the access for the Dutch to block, such as monopoly Lotto demanded.

The High Council has all the symptoms of the England-based Ladbrokes dismissed and the appeal of the site will be rejected. Thus, the blockade of the site for Dutch internet users has set, remain in force. The judge ordered in 2003 that blockage in a matter that Lotto was started. In the following quotations came higher courts to the same conclusions.

Lotto in the Netherlands, the only party a licence to offer games of chance via the internet and the company will need to meet all kinds of requirements. Ladbrokes did not and, therefore, would be unfair competition and violation of the Law on games of chance, was the claim. According to the British site violated the Dutch state and European legislation, with the state monopoly on online gambling services. Before the High Council to a judgment, it had, therefore, to ask some questions to the European Court of Justice are outstanding.

It was, among others, the question or the introduction of new games and advertising by Lotto, however, coincided with the reduction of gambling addiction. The Court of Justice showed last year know that this was next to each other can exist and that it is up to the judge in a member state, in order to verify the do not go too far for a restrictive gaming policy. Also, the European Court of Justititie that a member state may refuse, even if that provider of gambling services in another member state or has obtained a permit, such as in the case of Ladbrokes. This would not infringe on the free movement of services.

The High Council comes also to the conclusion that the Dutch state and its inhabitants may protect against the risk of fraud, crime and gambling addiction by a verguning for the provision of games of chance via the internet and telephone to refuse.

State secretary Teeven of Justice had initially planned to online gambling in the Dutch market, to liberalize, allowing foreign sites is active here could be. A Kamermeerderheid found, however, that there was a lack of attention for gambling addiction in the plans.
