In the hardened patentruzie between Apple and Motorola has former of a major battle beaten. Apple has a patentzaak in Germany won making it a sales ban on the Xoom can enforce.
In the conscious patentzaak, which in Germany was submitted, was Motorola guilty of infringing on a patent of Apple that has to do with displaying photos. Apple won, however, not all of the claims in the lawsuit had set out, making ‘only’ two smartphones and the Xoom tablet, according to the court, infringe on the patent, reports Foss Patents.
It comes to the European patent with number EP2059868 by Apple in the lawsuit against Motorola was used. Previously, this patent is already being used in a case against Samsung that Apple has submitted in the Netherlands. Samsung was found guilty, and had the conscious element from his software to get a sales ban of the Galaxy S II to avoid. In addition, fit Samsung already the design of its Galaxy Tab tablets to a German sales ban, again enforced by Apple, to work.
If Apple a sales ban to try to enforce, then it is not likely that the consumer here are some of the brands. Probably will Motorola then software to adjust the infringing element to remove.
However, it is not the first time that one of the two parties to a sales ban to enforce. Motorola managed to put in to the sale of certain Apple products banned. Apple went against this appeal, so the ban for now is suspended. On the other hand won Apple a case in which Motorola accused of infringing on a patent that is a slide-to-unlock-technique describes.
Apple and Motorola have long been embroiled in a legal fight, in which there are regularly new lawsuits may be brought. Often, these things in Germany settled, presumably due to the fact that the courts were ruling.
