Google the Netherlands have the right information about a foundation not of Maps to remove. The stichtingnaam is not personal data, even though it contains the names of the persons behind the organization, and they live at the same address.
The court of Amsterdam ruled Thursday in favor of Google the Netherlands in a case that was filed by two persons who live together in a foundation to manage. The two were of the opinion that Google is the Personal data Protection Act violated, because Google Maps and Street View the address of their foundation portfolio. Also; they turned against the use of a satellite image of the property and blurry pictures of the driveway. There would be privacyinbreuk because the name of the foundation the names of the persons, and the duo also look at the corresponding address of residence.
In the judgment, the judge states, however, that there is no personal data, as referred to in the Personal data Protection Act. It does not have to be so that users the name of the foundation in connection with the two persons, and nowhere shows this also, according to the court: “The bond between a natural person and the legal entity that bears its name can be very diverse.” Also the fact that the two live at the same address is not, of course, and Google is also not known, says the judge.
