A court in Shanghai has a request from the Chinese Proview Technology for a sales ban of iPad tablets in the city rejected. The two companies have a dispute about who the rightful owner of the iPad trademark.
According to the Shanghai Pudong New Area People’s Court, the court in Guangdong not yet decided on which party the iPad trademark ownership, and pending that decision, there is insufficient evidence for the violation of the trademark. Hence, the court in Shanghai has decided the request from Proview Technology to set up a temporary sales ban of iPad tablets from Apple to reject. Apple has three Apple Stores in the city.
Although the court in Shanghai now in favor of Apple has decided, local authorities have in a number of other cities in China iPads seized or retailers at the expense of a court order stopped the sale.
Apple says the iPad trademark in 2009 to have bought from Proview Taipei, but according to the Chinese branch of Proview gold that is not for China, as it is in the 2001 release from Proview Taipei the trademark for that region claimed. Apple combats that view.
