German government is considering antipiraterijbeleid with ‘two-strikes’

The German government is still in the first half of 2012 to decide on the introduction of a so-called two-strikes model, in which internetpiraten two warnings. Closing the internet connection then follows.

The German ministry of Science and Technology has a study to the anti-piracy policies in various European member states and the consequences of those actions. In the research is the opinion that a combination of prevention and repression is necessary. The researchers came to the conclusion that a warning system would be desirable and legally possible in Germany.

“The study represents a valuable basis for further discussion on combating piracy via internet,” explains state secretary Hans-Joachim Otto of the federal ministry. He is in favor of the warning system, but had previously know nothing, to feel for the third ‘strike’: the shutdown of the internet connection. France has a three-strikes policy.

After the second warning would be, if any, the penalty may follow that already exists in Germany. The court can copyright owners on the basis of the ip address of the customer data to retrieve the internetpiraat and therefore to the court. The study reported some regarding the creation of a central database with ip addresses of repeat offenders, to the British example. Anonymous data would from time to time to collecting societies should be sent, who can then decide whether they are against the large-scale downloaders, to come into action.
