Electronic Arts loses the dispute to ssx.com

Publisher Electronic Arts has an American arbitration board could not convince that it has the right domain name ssx.com. The domain remains in the hands of Abstract Holdings International, that the domain in October bought.

Electronic Arts switched on in november, the Us National Arbitration Forum, a committee that mediates in disputes about domain names. EA argued that it was entitled to the domain ssx.com because it has been since 2000 uses the title SSX for various snowboardgames. The latest version of the game, which simply SSX is called, will be out in February for Xbox 360 and PlayStation 3. EA argued further that the SSX since 2005, a registered trademark is that in the name of the publisher. EA argues, therefore, that Abstract Holdings International wrongly uses the domain and ssx.com in addition, used to generate income that can be traced back to the use of the brand name SSX. There were game-related ads on the domain name linked website.

EA knew the three members of the commission, however, not to convince. Abstract Holdings International argued that the domain name is already in march 2000, is recorded, before EA use was to create the abbreviation. The domain name is part of a collection of random three-letter abbreviations used at the same time are recorded, and several times since then as collection are sold. Abstract Holdings International purchased the collection in October, for $ 200,000.

The owner indicated that there may be a short period misleading manner, use is made of the domain, but that this is not longer than a month lasted. It is by Google the automatically generated ads at the website were visible. Then loved the AHI to the commission a list of companies that also make use of the brand name SSX. The company argued that EA, the name may use it for games, but that other companies should use for other types of products. A number of the companies on the list has the name SSX even if a registered trademark is recorded. On this basis, the commission concluded that Abstract Holdings International no abuse has made of the domain name, and it does not need to EA.
