A German judge has ruled that Apple’s mobile products infringe on two patents no longer allowed to sell. It probably goes to the iPhone and iPad, but currently there is still much uncertainty about the matter.
The statement is not published, but patentdeskundige Florian Mueller received the verdict through a source in hands and set him on his blog. The court does not which Apple products infringe on two patents, but it is likely that the to all mobile devices, like the iPhone and the iPad.
Previously, according to Mueller the same patents in the United States at Motorola are awarded used in court, where the manufacturer asked for the sale of all Apple mobile devices to prohibit. It comes in the German lawsuit by two patents with numbers 1010336 and 0847654 that relate to techniques for data synchronization and transfer. One of the patents requires a mobile data connection, something only the iPhone and iPad with 3g.
With the ruling, a so-called ex-parte decision where Apple is not even before the judge appeared, can Motorola with a sales ban to enforce. That can also as Apple in the meantime has lodged an appeal against the decision. Previously, that happened in a lawsuit between Apple and Samsung, where the latter are not longer Galaxy Tab 10.1 could sell. The sale of Apple products in other countries seems not to be in danger, because the German right will not be allowed to judge.
Apple has in a statement to Cnet to let you know that it is by the judgment of the court ‘currently’ is not restricted in selling mobile devices in Germany. Possible this is claimed because the court ruled against Apple Inc., the parent company, and not Apple Germany, the products actually sell. According to Mueller the sales through the Apple website will probably be discontinued. Also, Apple may not have new copies provide to German companies, including the German branch of Apple. It is unclear whether the company from Cupertino will appeal the ruling, but it is plausible.
Google has made some time ago indicated Motorola would take over for $ 12.5 billion, but the internetgigant has still no green light. With Motorola’s many patents want the internetgigant especially in the field of intellectual property strengthening: many Android manufacturers have been sued because of patentschending. In addition to pay various manufacturers licentiegeld to Microsoft for the use of a number of patents, which is the cost of Android smartphones do increase. Google has already shown behind Android manufacturers in patentzaken.
