Gabriel takes legal proceedings against the stop of the supermarket merger

The dispute over the merger of Edeka and Kaiser’s Tengelmann in the next round: Federal Minister of Economics Gabriel turns now to the Federal court of justice. Can he enforce the controversial Takeover yet?

Federal Economics Minister Sigmar Gabriel (SPD) does not want to leave the decision of the düsseldorf higher regional court (OLG) to sit. He is going to stand up legally against the stop of the merger of Edeka and Kaiser’s Tengelman by the court.”We will not go into this week in the appeal before the Federal court of justice,” said the SPD chief on Sunday in the ARD Interview. “We believe that we have good arguments,” the Minister is safe. Due to the Takeover of Kaiser’s Tengelmann by Edeka is not a supermarket-giant would arise, but it would still be enough competition.

Gabriel is about cartel office over

Gabriel had allowed Germany’s largest food retailer Edeka in March, by Ministerial permission to take approximately 450 stores of Kaiser’s Tengelmann. The alleged “secret negotiations”

At the end of July he had already filed a so-called “constituent request for correction” at the higher regional court of Düsseldorf. The Minister wanted the accusation of “secret negotiations” in the world. The court had held the Minister of the economy, in his decision, he had led secret talks with Edeka and Kaiser’s Tengelmann.

Edeka has submitted against the provisional decision of the OLG already a non-admission complaint at the Federal court of justice. The Federal court must now consider whether the admission of the appeal by the düsseldorf higher regional court, or not. If not, it must deal with the content of the Express decision.
