Countries of origin – nothing is safe
Are Algeria, Morocco and Tunisia declared “safe countries of Origin”? The Chancellor wants it, the Grand coalition want to. But from the provinces, comes before the vote in the Bundesrat resistance.
If you look at how many refugees have come in may to Germany, then the German government makes a law for 374 people. So many asylum-seekers arrived last month from the Maghreb: 185 from Morocco, 134 from Algeria, 55 from Tunisia. No numerical values. That these three countries should now be considered as “safe countries of Origin”, however, has a history.
As the new year’s eve, hundreds of women were night harassed in front of the Cologne Cathedral and robbed, were among the perpetrators, many North African men. There is also a refugee papers were found at the Suspect, drew many politicians to the conclusion: people from the Maghreb have their asylum-seeker Status, abuse, and crimes committed.
In fact, about 25,000 people from Morocco, Algeria and Tunisia came to Germany in the year 2015. Asylum got from them but only around 600. The so-called protection ratio for Tunisia at 0.2 percent, Algeria at 1.7 per cent, and Morocco at 3.7 percent. In the crime statistics against immigrants from the three Maghreb countries were represented significantly more.

There is no systematic persecution
For the Federal government, the Figures confirm the impression that the Federal Minister of the interior Thomas de Maizière during a trip in early March, and the German Ambassador confirm: although There are good reasons to leave the Maghreb from a lack of prospects. A systematic political persecution or inhuman treatment there. Therefore, the Federal government has brought a law, the three North African States as a so-called safe countries of Origin are to be defined.
Asylum applications of people from such countries could then be fast-tracked. That would mean: Within a week it will be decided, and the applicant must meanwhile live in a special facility. As the Western Balkan States were declared to be time to safe third States, were there significantly fewer immigrants to Germany.
Concerns in Green, and human rights organizations
As 2014 and 2015, a vote was taken on the Balkan States, there was in Germany a political majority for the amendment of the law. Despite the gnashing of teeth, after all, were the Greens agree. This time it looks different. The Greens do not say that The Maghreb is the Balkans. They are based on the findings of human rights organizations.
Amnesty International and Pro ASYL, for example, to say that in all three countries, tortured, and members of the opposition and homosexuals are persecuted. Interior Minister de Maizière, however, that each individual case would be looked – for him a rejection of his project is “nonsensical ideology”. But the Greens seem to want hart to stay. Your core brand is at stake: the use of human rights.
Complicated situation in the Bundesrat
The concerns of the Greens could be the Federal government of CDU/CSU and the SPD, regardless, would not the Federal Council, the chamber of States, the law agree. There, the Greens are now represented in ten of the 16 state governments. In the countries where they join the government, do you want to prevent a consent to the act.
The editorial recommends
Bundestag: the Maghreb countries are “safe”
The Bundestag has decided that the three States of Morocco, Algeria and Tunisia are to be declared “safe countries of Origin”. The Federal government expects this decline in asylum numbers. (13.05.2016)
Sugar bread and whip in the refugee policy
The EU Commission wants to stop the influx of refugees from Africa. Pressure and incentives to encourage African countries to close their borders and to take back migrants. (07.06.2016)
De Maizière dissatisfied with the pace of deportations
The Federal Minister of the interior complained of significant deficits in the case of the deportation of rejected asylum seekers. Throughout the year, he expects 27,000 repayments. Actually, more than 51,000 people in Germany would have to leave. (01.06.2016)
Only Baden-Württemberg could opt out. It is considered unlikely that the green Minister-President Winfried Kretschmann, want to snub his conservative coalition partners as early in the common term of office. CDU interior Minister Thomas Strobl is because of a consent, and speaks of “reliability”. For a majority in the Bundesrat, baden-württemberg would not be enough “Yes” anyway.
Great Signal
If one considers only the Numbers of incoming refugees, could be the government of the outcome of this political dispute is almost no matter. The cases of the few immigrants from North Africa, according to the existing law quickly edit. Many observers suspect that the government wanted to after the incidents in Cologne, Germany, primarily: the ability to act, to demonstrate.
In fact, however, is neither clear whether the Numbers remain so low, still what is the Signal of a defeat of the coalition were. In government circles, presumptions such as: circulate”, The AfD would have to say not the get the government” and “If we demonstrate that these States are not sure, again, people with hopes, on the way to Europe”.
There is another reason, which is why the Federal government want to control by press: Berlin wants to achieve, that is, Morocco, Algeria and Tunisia accept the return of all deported refugees. You don’t do often. As a reward for this cooperation, Germany had promised the seal of “safe country of origin”. The Maghreb countries would not have to confirm on this detour that you violated the human rights. If this classification fails, it could also be the readmission agreement is difficult.
Compromise in sight
Therefore, the government parties have a large interest in it to agree with the Green – either before the vote in the Bundesrat, or after a Failure in the conciliation Committee. There is then a compromise would be sought. An idea is to protect particularly vulnerable “vulnerable people” such as journalists, homosexuals, and members of the opposition by a separate procedure. A compromise could also be called: The label “safe”, many opposition politicians, is avoided. Instead, it could be defined in the law for asylum applicants from countries that have a very low recognition rate (for example, five percent), it is automatically a fast-track procedure is used.
Then, an important objective of the law would be achieved not be released without this countries early from the responsibility to respect human rights. The Greens can live with this model may be – after all, the proposal comes from them. If the Conservatives and social Democrats that is enough, it will show in the Bundesrat. Until then applies: Nothing is for sure.
