In 2013 and 2014 was the thuiskopieheffing too high, the court in The Hague has ruled. In determining the amount of the charge is alleged damage from download is included, but that was not allowed, according to the court.

That the damage from download from illegal source was included, was in conflict with the legal prohibition on arbitrariness, writes the court in the verdict of Computerworld is published. However, it is unclear what the height of the thuiskopieheffing than it should have been, and whether the companies that the lawsuit he paid too much money reclaim: this must be a vervolgzaak definite answer to offer.

The case went on the thuiskopieheffing from 2013 and 2014. This year is the thuiskopieheffing already reduced, due to the downloadverbod that in april of last year came into force. This means the damage illegal downloading does not have to be taken into account when determining the height of the thuiskopieheffing. That means that the tax on some of the devices is halved: so it was on a pc 6,05 euro thuiskopieheffing be paid, where it is now 3.50 euros.

The case was filed by, among others, Acer, HP, Dell, Kodak and Nokia. They really wanted the thuiskopieheffing all the way from the table to see, but the court did not agree.
