Activision opens hunting in domain name modernwarfare3.com

Publisher Activision tries to take ownership of modernwarfare3.com. The company has a procedure instituted with the Us National Arbitration forum order the domain from the current owner to take away.

According to Activision, the current owner of modernwarfare3.com, Domains by Proxy Inc., is not entitled to the domain. The publisher refers to in an eleven-page document, in which the complaint is set out, to the Uniform Name Dispute Resolution Policy, as established by the Internet Corporation for Assigned Names and Numbers, on October 24, 1999. It states, inter alia, that a relocation or expropriation of the domain is necessary, if this is too similar to a trademark in which the prosecutor of the rights.

Also mentions the policy that a party with rights in a domain name can be lost if there is no legitimate interest in the domain. Activision notes in the document that modernwarfare3.com visitors sent to the official website of Battlefield 3, a shooter game from competitor Electronic Arts. According to Activision confirms this action of the owner that there is no evidence of a legitimate interest. In addition, would the owner of the domain earlier material to which a copyright of Activision is resting on his website, says Activision in the document.

Activision has with the document is a cheque of the 2,600 dollar added to the cost of treatment of this case by three panelists to pay. Domains by Proxy Inc. has twenty days to the National Arbitration Forum and Activision have a response to send. After a few intermediate steps will the Forum eventually, to make judgments about who modernwarfare3.com due.
