The OPTA does not see any reason the cable connections to break open for television services. The importance of analogue tv takes up compared to that of digital television and there would be on the tv market, plenty of alternative infrastructures.
The OPTA decided earlier that UPC and Ziggo competitors on the analog cable connections had to allow, because there is too little competition on that market. The CBb annulled that decision, however, because there is the one and the other seized on the analysis of the telecomwaakhond. In the concept of the new analysis, the OPTA to a very different conclusion.
“More and more end users are opting for digital television services. Most consumers can now have multiple platforms to choose for a wide range of digital television services. The advantage that UPC and Ziggo because of their analog television offering compared to competitors has narrowed, according to the authority.
Entrants to the television market can make use of cable, copper, glass, digital terrestrial and satellite, and therefore independent of Ziggo and UPC television services offering, concludes the OPTA. The cable would be an advantageous position compared to copper, satellite and digital ether, but not compared to fiberglass, says the judgment further.
The study differs from the analysis of 2009, because “the competition develops faster than the college had supposed’. The OPTA is expected that there will be no regulation more necessary to the television market is competitive. Tuesday I received the Belgian regulators criticism of Commissioner Kroes, due to decide to the cable connections to break open. The regulatory authorities would, according to Kroes ‘better to take into consideration the market developments in the light of new players on the market, the trend towards multiplay and the convergence between broadband and broadcasting.”
At the same time, from cable-tv providers have an obligation to their analog program offerings available to competitors. This is the result of the amendment of PvdA Member of the Dutch parliament Martijn van Dam on Wednesday by the Second Chamber adopted a new telecom law. Also, the law gives the OPTA the possibility of resale of the digital program offer to enforce at kabelaanbieders, but this will be the OPTA so probably no use. The First Chamber must still rule on the law.
