UN special Rapporteur: Khashoggi-murder is a “State crime”

The Saudi Journalist, Jamal Khashoggi, was killed by representatives of Saudi Arabia, says UN special Rapporteur Agnès Callamard, compared to the DW. Against crown Prince Mohammed bin Salman should be determined.

DW: How did you come to the conclusion that there is “credible evidence” that the Saudi Arabian authorities bear responsibility for the death of Jamal Khashoggi?

Agnès Callamard: The first important finding of my study relates to the responsibility of the state of Saudi Arabia. So far, the Saudi’s have passed authorities to the fact that this was not a state-sanctioned crime, but a Schurkentat.

My report shows that the murder of Jamal Khashoggi meets all the criteria of a state crime. Officials of the state have directed and executed. You have relied on state funds and resources. The Team flew to Istanbul, used a private jet with diplomatic approval. The murder took place in the Saudi Consulate. The Saudi Consul himself made sure that on the day of the murder, no witnesses were present. These and other in the report presented the evidence to mean that there is no other possible conclusion than that the murder was the, what we call a state murder.

If it is a governmental murder, which was committed by state officials with state funds, as your report noted, this means that crown Prince Mohammed bin Salman for the murder of Khashoggi responsible or liable?

My investigation of a human rights investigation, which focuses on the responsibility of the state. In this connection, I have examined the individual liability only, in order to determine whether, in my opinion, worthy enough credible evidence for an international criminal investigation.

My conclusion is that there is, on the basis of my findings and analyses are in fact credible evidence that a criminal investigation of senior officials require – including the crown Prince.

I would like to emphasize that the possible liability of the crown Prince depends not only on whether he has arranged the crime or not. Also important is the search of a smoke is a weapon. This is not the only Form of responsibility for a high-ranking official.

In a civil context, there is such a thing as a chain of command, and a number of related responsibilities. For example, incited the crown Prince or someone else directly or indirectly, to the murder of Mr Khashoggi turned on? The crown Prince, or somebody else knew of the planned murder, but took no measures to prevent it? The crown Prince or someone else knew – or should have known, that the murder of Mr Khashoggi, in view of the numerous human rights violations that were committed in the year before his death, represents a real possibility? All of this must be the subject of a thorough criminal investigation.

Where is this criminal investigation? How should be the Jurisdiction?

I recommend that international criminal investigations at the level of the United Nations. I call on the UN Secretary-General to appoint a panel of experts, that the individual responsibility on the basis of the evidence examined.

Agnès Callamard is since 2016, the special Rapporteur on extrajudicial, summary or arbitrary executions at the office of the High Commissioner of the United Nations for human rights. The French human rights expert conducts additionally, since 2013, the project on Global Freedom of Expression at Columbia University in New York City.
