Nintendo wins lawsuit about import Wii in USA

The U.s. Federal Circuit Court of Appeals, Nintendo has prevailed in a lawsuit that Motiva LLC in 2008 November. The American company claims that Nintendo infringed on its patents. The court notes, however, that Motiva only on monetary gain.

The Court confirming a ruling from January 2012, the U.s. International Trade Commission, or USITC, that many patentzaken handles. Motiva claims that the Wii use is made of techniques, which are based on two patents that it owns. It comes to patents on the detection of the position and movement of the body of the player. The three-man Court, however, in the conclusion of the USITC that Motiva is only a compensation or a settlement and has no plans to use the patents that it has. The Court found that Motiva no efforts has made to the patents to commercialize, and therefore does not meet the conditions laid down in the law are made. Motiva tried the import of the Wii in the US. That danger is now gone.

It is not the first time that an American court the requirement to have an import of a game console rejects. At the end of 2012, it was Motorola to be in the wrong in a case it had filed against Microsoft. Motorola tried to sell the Xbox 360 in the USA because Microsoft would infringe on patents that are in the possession of the manufacturer, which is currently used by Google is incorporated.
